1. Agreement to Terms

By accessing or using BookThis ("the Platform", "we", "us", or "our"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you may not access or use the Platform.

These Terms constitute a legally binding agreement between you and BookThis. We reserve the right to update these Terms at any time, and your continued use of the Platform constitutes acceptance of any changes.

2. Definitions

• "Platform" refers to the BookThis website, application, and all related services
• "Member" refers to users who book classes, workshops, or events through the Platform
• "Host" refers to instructors, trainers, venues, or organizations offering classes through the Platform
• "Event" refers to classes, workshops, sessions, or activities bookable through the Platform
• "Booking" refers to a confirmed reservation for an Event
• "Membership" refers to subscription plans offering access to Events

3. Eligibility

To use the Platform, you must:

• Be at least 16 years of age
• Have the legal capacity to enter into binding contracts
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Comply with all applicable laws and regulations

Minors under 18 may use the Platform with parental or guardian consent and supervision.

4. Account Registration and Security

4.1 Account Creation

You must create an account to use most features of the Platform. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Keep your password secure and confidential
• Notify us immediately of any unauthorized account access
• Be responsible for all activities under your account

4.2 Account Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms, engage in fraudulent activity, or for any other reason at our sole discretion. You may close your account at any time through your account settings.

5. Bookings and Reservations

5.1 Making Bookings

When you make a booking through the Platform:

• Your booking is subject to availability and Host acceptance
• You will receive a confirmation email upon successful booking
• You are responsible for attending at the scheduled time
• You must comply with the Host's rules and requirements
• You agree to pay all applicable fees

5.2 Booking Modifications

Booking modifications are subject to the Host's policies and Event availability. Some bookings may be non-refundable or subject to cancellation fees. See our Refund & Cancellation Policy for details.

5.3 Waitlist

If an Event is full, you may join a waitlist. You will be notified if a spot becomes available, but placement on a waitlist does not guarantee a booking.

5.4 No-Show Policy

Failure to attend a booked Event without cancellation may result in:

• Forfeiture of payment or membership credits
• Booking restrictions
• Account suspension for repeated no-shows

6. Memberships and Credits

6.1 Membership Plans

Membership plans provide access to Events according to the plan terms:

• Memberships auto-renew unless cancelled before the renewal date
• Membership benefits apply only during the active subscription period
• Unused benefits do not carry over unless specified in the plan
• Membership pricing may change with notice

6.2 Credits and Packages

Class credits and packages:

• Must be used within the validity period (typically 3-12 months)
• Are non-transferable and non-refundable unless required by law
• Cannot be redeemed for cash
• May have restrictions on certain Events or peak times

7. Payments and Fees

7.1 Pricing

All prices are displayed in the currency shown on the Platform and include applicable taxes unless otherwise stated. Prices are subject to change at any time, but changes will not affect existing bookings.

7.2 Payment Processing

Payments are processed securely through our payment provider, Stripe. By making a payment, you agree to Stripe's terms of service. We do not store your complete payment card details on our servers.

7.3 Payment Authorization

By providing payment information, you authorize us to charge the specified amount for bookings, memberships, and other services. You represent that you have the legal right to use the payment method provided.

7.4 Failed Payments

If a payment fails, we may attempt to process it again. Continued payment failures may result in:

• Cancellation of bookings
• Suspension of membership benefits
• Account restrictions

8. Host Responsibilities

If you are a Host using the Platform, you agree to:

• Provide accurate Event descriptions, schedules, and pricing
• Honor all confirmed bookings
• Maintain appropriate insurance and certifications
• Comply with all applicable health, safety, and legal requirements
• Provide safe, professional services
• Handle Member data in compliance with privacy laws
• Respond to booking inquiries and messages promptly
• Keep your schedule and availability updated

Hosts are independent contractors, not employees of BookThis. We are not responsible for Host conduct, Event quality, or safety.

9. User Conduct

You agree not to:

• Use the Platform for any illegal or unauthorized purpose
• Violate any laws in your jurisdiction
• Infringe on intellectual property rights
• Transmit viruses, malware, or harmful code
• Harass, abuse, or harm other users or Hosts
• Impersonate any person or entity
• Scrape, copy, or reverse engineer the Platform
• Circumvent security measures
• Share or resell bookings without authorization
• Submit false or misleading information
• Interfere with Platform operations

10. Intellectual Property

All content on the Platform, including text, graphics, logos, images, software, and trademarks, is the property of BookThis or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works without our express written permission. You are granted a limited, non-exclusive, non-transferable license to access and use the Platform for its intended purpose.

11. Health and Safety

Important Notice: Physical activities carry inherent risks. By booking Events, you:

• Acknowledge the physical nature of activities and associated risks
• Confirm you are physically capable of participating
• Agree to consult a physician before starting any new fitness program
• Accept full responsibility for your participation
• Release BookThis from liability for injuries or health issues

If you have any medical conditions, injuries, or concerns, inform the Host before participating.

12. Disclaimers and Limitation of Liability

12.1 Platform Provided "As Is"

The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

12.2 No Warranty

We do not warrant that:

• The Platform will be uninterrupted or error-free
• Defects will be corrected
• The Platform is free from viruses or harmful components
• Information on the Platform is accurate or reliable
• Events will meet your expectations

12.3 Limitation of Liability

To the maximum extent permitted by law, BookThis, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, or data
• Business interruption
• Personal injury or property damage
• Loss of goodwill

Our total liability shall not exceed the amount paid by you to BookThis in the 12 months preceding the claim, or £100, whichever is greater.

12.4 Host Responsibility

BookThis is a platform connecting Members with Hosts. We do not employ Hosts, conduct Events, or control Host conduct. Hosts are independent service providers responsible for their own actions, qualifications, insurance, and compliance with laws.

13. Indemnification

You agree to indemnify, defend, and hold harmless BookThis and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Platform
• Your violation of these Terms
• Your violation of any law or rights of others
• Your participation in Events
• Content you submit to the Platform

14. Dispute Resolution

14.1 Informal Resolution

If you have a dispute with us, please contact us first at support@bookthis.com to attempt an informal resolution.

14.2 Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.

14.3 Jurisdiction

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

15. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms on the Platform
• Updating the "Last updated" date
• Sending email notification for significant changes

Your continued use of the Platform after changes become effective constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Platform.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and BookThis regarding the Platform and supersede all prior agreements.
